ORDER

The petitioner, who was arrested and remanded to judicial custody on 19.08.2025, for the offences punishable under Sections 296(b), 326(g) and 351(3) of BNS in Crime No.232 of 2025, registered on the file of the respondent police, seeks bail. The earlier bail application of the petitioner was dismissed by this Court, vide order dated 11.09.2025 in Crl.O.P.No.24873 of 2025.

The case of the prosecution is that the defacto complainant is the owner of the property, which he had rented to the wife of the petitioner herein; that on 18.08.2025, the petitioner broke open the lock of the rented premises and set fire to the house on fire using petrol and caused damaged to the household articles; that further the petitioner abused the defacto complainant using filthy words and threatened of dire consequences. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner was falsely implicated and on the said day of occurrence, the 2/4

petitioner lit a lamp near the bed due to outrage of power failure; that thereby, the lamp toppled and fire accident caused and there is no deliberate involvement of the petitioner and he is in judicial custody since 19.08.2025. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that the petitioner has seven previous cases; and that the investigation is pending.

Considering the facts, gravity of offence, the previous antecedents of the petitioner, there is no change of circumstances after dismissal of the earlier bail application of the petitioner in Crl.O.P.No.24873 of 2025 and the investigation is pending, this Court is not inclined to grant bail to the petitioner. 3/4
