ORDER

The petitioners, who apprehends arrest for the alleged offence punishable under Sections 406, 420 of IPC, in Crime No.896 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The petitioners have filed this petition seeking anticipatory bail on the allegation that the petitioner herein has promised the defacto complainant in getting a job in Tamil Nadu Public Service Commission and collected a sum of Rs.1,05,000/-. Hence this case.

3. The learned counsel appearing for petitioners submitted that the matter was already referred to Mediation and subsequent to the negotiations held during Mediation, the matter was amicably settled between the parties.

4. There is no representation for the defacto complainant. The Mediation report has been received by this Court and it reveals that there was negotiations between the parties and finally a compromise was entered into between them. Since the dispute between the parties had ended in a settlement, and a Memo of Compromise was filed before this Court, this Court is inclined to grant 2/6

anticipatory bail to the petitioners with certain conditions.

Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen (15) days from the date of receipt of a copy of this order before the learned Judicial Magistrate, Ambattur, on condition that the petitioners shall execute a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only), with two sureties, each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned and on further condition that:

(a) the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;

(b) the petitioners shall report before the respondent police daily at 10.30 a.m., for the period of two weeks and thereafter as and when requires for interrogation; (c) the petitioners shall not tamper with evidence or witness either during investigation or trial; (d) the petitioners shall not abscond either during 3/6

investigation or trial;

(e) on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and;

(f) if the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. (g) consequently, the connected crimilan miscellaneous petition is ordered.
