ORDER

The petitioner, who was arrested and remanded to judicial custody on 14.07.2025, for the offences punishable under Sections 194 BNSS (Hanging) @ 61(2), 318(4) and 108 of BNS in Crime No.89 of 2025, registered on the file of the respondent police, seeks bail. 2.

The case of the prosecution is that the petitioner/ A6 joined hands with other accused, impersonated herself as a bride by changing her name in the Aadhaar Card and married the deceased by receiving a sum of Rs.1,20,000/-; that thereafter, the petitioner cheated the deceased and ran away from the house within two days from the date of marriage, due to which the deceased has committed suicide by hanging. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and the petitioner is in judicial custody since 14.07.2025, the co-accused were already granted bail by this Court and ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that the investigation of this case is pending. He further submitted that the co-accused/ A1 to A3 are still absconding and the petitioner is the prime accused in this case, who impersonated herself as bride and cheated the deceased.

Considering the facts, gravity of offence, since the petitioner is the prime accused and played a vital role in this case and the investigation is still pending, this Court is not inclined to grant bail to the petitioner. 6.

Accordingly, this criminal original petition stands dismissed. 23.09.2025 stn 3/4
