The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 4(1)(A) and 4(1)(C) of TN Prohibition (Amendment) Act, 2024, under Section 123 of BNS, 2023 and under Section 24(1) of Cigarette and other Tobacco Products Act, 2003, in Crime No.467 of 2024, on the file of the respondent police, seeks anticipatory bail.

2. Pleading innocence on the part of the petitioner, false implication in the case, learned counsel for the petitioner seeks indulgence of this Court. He would further submit that the petitioner is ready to abide by any stringent condition that may be imposed by this court.

3. The case of the prosecution, as putforth by the learned Government Advocate (Criminal Side) appearing for the respondent police, opposing for grant of anticipatory bail, is that based on a secret information, the respondent police went to the petitioner's house and found that the accused was involved in the illegal sale of government liquor bottles for a higher profit. He would further submit that 40 Government Liquor Bottles were seized from the petitioner and 40 packets of Gutka were seized from the shop near the house of the petitioner. https://www.mhc.tn.gov.in/judis 1/2

mac He would further submit that there are two previous cases pending as against the petitioner, out of which, one case is similar in nature.

4. Heard the learned counsel for the petitioner, the learned Government Advocate (Crl. Side) appearing for the respondent police and perused the materials available on record including the FIR.

5. Taking into consideration the facts and the submissions made by the learned Government Advocate (Criminal Side) and also considering the previous cases pending against the petitioner, this Court is not inclined to grant bail to the petitioner.
