2. Heard the learned counsel for the petitioner/appellant.

3. The learned counsel appearing for the respondents 1 & 2 have no objection for this petition being allowed.

4. Despite service of notice on the third respondent and the name is also printed in the causelist. However, none appeared on behalf of the third respondent.

5. Sufficient reasons have been given in the affidavit filed in support of the petition. Accordingly, the delay is condoned and the petition is allowed.
