ORDER

This writ petition has been filed challenging the order dated 20.11.2024 passed by the respondent thereby informed that there is no affiliation for the academic year 2024-2027 and if any of the student admitted in the B.Ed., Course, the University will not be responsible for anything.

The petitioner institution is affiliated with the respondent University by the proceeding dated 02.12.2021 and this affiliation continued till 2024. The petitioner was directed to apply for continuation of provisional affiliation for the next three academic years viz., 2024 to 2027 in the prescribed formate on or before 31.10.2023. Accordingly the petitioner applied for the grant of continuous affiliation along with required documents. The petitioner also paid requisite fee. However, on 05.03.2024, the respondent constituted a committee for the inspection of the petitioner institution for considering the request for the grant of

continuous affiliation. On 07.03.2024, an inspection was conducted on the petitioner's premises and submitted report for continuous affiliation. Further, by the communication dated 21.09.2024, directed the petitioner to furnish 17 documents. Accordingly, the petitioner appeared in person before the respondent and submitted documents as required by the respondent. Thereafter no order was passed by the respondent whether the affiliation granted or not to the petitioner institution. Though the petitioner institution submitted representations and reminders, no order has been passed by the respondent. Finally on 20.11.2024, the respondent informed that grant of continuous affiliation is not feasible as per the Syndicate Resolution and therefore, no admission is permitted for the academic year 2024-2025. So far, no order was passed on the application in order to reject the request for grant of continuous affiliation. In view of the interim order passed by this Court, the petitioner institution admitted the student for B.Ed., Course from the academic year 2024-25.

The learned Standing Counsel appearing for the respondent submitted that after receipt of the show cause notice the petitioner

submitted only 7 documents out of 14 documents. Therefore, the petitioner failed to fulfill the other requirements as per the show cause notice. Hence the affiliation was not continued and restrained the petitioner not to admit any students for the academic year 2024-2025. 4.

Heard the learned counsel appearing on either side and perused the materials placed before this Court. 5.

According to the petitioner, they had submitted all required documents. After having been kept quite for nearly six months, the respondent passed order on 20.11.2024 thereby restraining the petitioner not to admit any students for the B.Ed., Course for the academic year 2024-2025 without passing any order for continuous affiliation. 6.

In view of the above, the impugned order dated 20.11.2024, cannot be sustained and liable to be quashed. Accordingly, the order dated 20.11.2024 passed by the respondent in letter No.TNTEU/R/CPA/ 2024/01770, is hereby quashed. The respondent is directed to issue fresh notice noting down the defects, if any. On receipt of the same, the

petitioner shall comply the same and on compliance, the respondent shall pass an order on the request for grant continuous affiliation to the petitioner for conducting B.Ed., Course for the subsequent years 20252026, 2026-2027. It is made clear that the respondent is at liberty to conduct inspection, if required. Further, the respondent is also directed to publish the results those who had already admitted in the petitioner institution during the year 2024-2025 and provide them teaching practice.

With the above directions, the Writ Petition stands allowed. Consequently, connected miscellaneous petitions are closed. There shall be no order as to costs.
