ORDER
When the matter is taken up for hearing today, the learned Standing Counsel appearing for the respondent has produced the 1/4
proceedings of the concerned Wakf Superintendent dated 28.4.2024.
2. On going through the same, it is seen that 21 persons were elected.
3. The learned counsel for the petitioner has raised very serious objections regarding the manner, in which, the election had taken place. He has submitted that the existing persons have been virtually re-elected without a proper election process and that the so-called election that was said to have been conducted by the respondent is illegal and it will not stand the test of law.
4. In the considered view of this Court, going into the legality or otherwise of the election conducted by the respondent will be beyond the scope of this contempt petition. The writ petition was disposed of by this Court by directing the Wakf Board to take immediate steps to conduct the election and hand over the administration of the management to the elected members and that has now been done by the respondent.
5. If, according to the petitioner, the election is vitiated and it 2/4
suffers from illegality, it is left open to him to challenge the same in a manner known to law. Except granting this liberty, no further orders can be passed in this contempt petition.
