The Secretary To Government, v. M.Thiruneelakantan,
IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED: 25-10-2025
CORAM
THE HONOURABLE MR.JUSTICE K. SURENDER in REV.APLW SR NO. 162046 OF 2023 The Secretary To Government, Personnel And Administrative Reforms Department, Secretariat, Fort St.
George, Chennai-9.
2.The Secretary To Government, Finance Department, Secretariat, Fort St. George, Chennai-9.
Petitioner(s) Vs M.Thiruneelakantan, Section Officer (retd.), Public Department, Secretariat, Chennai 600009.
Respondent(s) PRAYER: This Writ Miscellaneous Petition is filed by the petitioner to condone the delay of 2408 days in filing the above Review Application in the orders of this Honourable Court dated 27.02.2017 in WP.No.27647 of 2013. For Petitioner Mr.V.Veluchamy AGP For Respondent(s):
Mr.M.Suresh Kumar, AAG Assisted by R.L.Karthika GA
ORDER
This petition has been filed seeking condonation of delay of 2408 days in filing the Review Application, seeking to review the order dated 27.02.2017 passed in W.P.No.27647 of 2013.
2. In the affidavit filed in support of the above petition, the respondents have dealt with the matter mainly on the merits, but this Court hardly finds any reason, much less a sufficient reason, for condoning the abnormal delay of 2408 day in filing the Review Application.
3. Though, Mr.M.Suresh Kumar, learned Additional Advocate General appearing on behalf of the respondents strenuously contended that the merits of the matter are required to be looked into while considering an application for condonation of delay, this Court is not inclined to look into the merits of the matter, as the Hon'ble Apex Court has recently held that the merits of the matter are totally irrelevant while considering a petition on condonation of delay in the case of " Pathapati Subba Reddy Vs. Special Deputy Collector" reported in
2024 LiveLaw (SC) 288.
4. In the light of the above, this Court does not see any reason to condone the abnormal delay of 2408 days in filing the Review Petition.
5. Accordingly, the Writ Miscellaneous Petition is dismissed. No costs. Rev.APLW. SR.No.162046 of 2023 is dismissed at SR stage itself. K. SURENDER, J.
