O R D E R

The petitioner has filed this writ petition seeking issuance of Writ of Certiorarified Mandamus to call for the records in connection with proceedings in office Memorandum No.C-10/05588/ 2022 dated 11.09.2023 of the respondent and quash the same and consequently direct the respondent to pay the arrears as entitled by the petitioner and calculate the petitioner's basic pay and other emoluments as per 6th pay commission, basic pay of Rs.25,330/- with AGP - 7,000 and pay the yearly increments as per law based on the petitioner's representation dated 20.07.2020 with incentives for the petitioner's M.Phil and PhD degree.

2.The learned counsel appearing for the petitioner submitted that the petitioner is working as Assistant Professor/ Programmer in the Division of Computer and Information Science, Faculty of Science at Annamalai University and he was appointed on 20.12.2001 with sanctioned scale of pay of Rs.8,000/- -275 - 13,500/-. The petitioner was given senior scale on September, 2008 and basic pay was fixed as Rs.10,000/- - 325 - 15,200/- and the next increment was availed During October, 2007. Since there was pay anomaly, the petitioner 2/5

made representation to the respondent seeking to rectify the same, however, there was no response and hence, the petitioner filed W.P.No.16995 of 2020 and pursuant to the order of this Court dated 09.11.2022 made in the said writ petition, the impugned proceedings, rejecting the request of the petitioner was issued. 3.The learned counsel appearing for the respondent submitted that the petitioner made representation after several years and the same is bereft of details, however, the same was considered as directed by this Court in W.P.No.16995 of 2020 dated 09.11.2022 and impugned proceedings was issued. The learned counsel further submitted that during the pendancy of this writ petition, the petitioner was dismissed from service on 25.10.2025 for the grave mis-conduct committed by him.

4.Heard the arguments advanced on either side and perused the materials available on record.

5.The grievance of the petitioner is that the petitioner made representation to the respondent seeking to rectify the pay anomaly, however, the same was rejected by the respondent. 3/5

6.Perusal of records reveal that at the time of implementation of the 6th Pay Commission recommendation, based on the petitioner's M.Phil. Qualification, he was given upward movement from one stage to other. His juniors Vadivazhagan and Natarajan were also given movement based on the pay matrix which was in force at that time. The petitioner had the option of challenging the Government Orders and Rules that were in force at that time if it were not palatable to him, however, without doing so, made representation bereft of details, after several years and the same was considered by the respondent and impugned proceedings was issued rejecting the request of the petitioner, which warrants no interference. Further, during the pendancy of this writ petition, the petitioner was dismissed from service on 25.10.2025 for the grave mis-conduct committed by him. 7.The writ petition is dismissed. No costs.
