ORDER

This Petition has been filed to condone the delay of 2517 days in representing the above S.A.SR.No.102266 of 2017.

2. Heard the learned counsel for the appellant, and perused the material available in the record.

3. The learned counsel for the appellant submitted that the petitioner's mother, Banumathy, had been following the case proceedings. Since the original petitioner was a minor at the time of filing the suit in 2009, his mother, who is now about 70 years old, was responsible for handling the matter. However, due to a lack of communication, she was unable to represent their appeal in time.

4. On being satisfied with the averments stated in the affidavit filed in support of the petition and the submissions made by the learned counsel for the petitioner, the above S.A.SR.No.102266 of 2017 is condoned.

5. Accordingly, this Civil Miscellaneous petition is allowed.

6. Registry is directed to list the above Second Appeal after numbering the same, if they are otherwise in order, 17.02.2025. 31.01.2025 rri 2\3
