Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, Directing the respondents to disburse the entire death cum retirement benefits, pensionary benefits and other monetary benefits accrued on the death of N. Prasath, former village Administrative officer, Thuraiyur village, Nagapattinam District to the petitioner by considering the petitioners representation dated 14.02.2025 and 28.07.2025 within a time frame to be fixed by this Honble Court. 1/5

O R D E R

This Writ Petition is filed seeking a direction to the respondents to disburse the entire death cum retirement benefits, pensionary benefits and other monetary benefits accrued on the death of N. Prasath, former village Administrative officer, Thuraiyur village, Nagapattinam District to the petitioner by considering the petitioner's representations dated 14.02.2025 and 28.07.2025 within a time frame to be fixed by this Hon'ble Court.

2. It is the case of the petitioner that his brother's son N.Prasath died due to a heart attack while he was working as a Village Administrative Officer. He died as a bachelor and his parents predeceased him. Since the said Prasath died as a bachelor and his parents predeceased him, the petitioner along with his siblings had filed a suit in OS.No.51 of 2024 on the file of the District Munsif cum Judicial Magistrate, Vedaranyam, to declare the plaintiffs therein as legal heirs of the deceased Prasath. The said suit was decreed as prayed for on 14.09.2024. Therefore, in view of the above decree, the petitioner is entitled to get the Death cum Retirement 2/5

benefits of the deceased Prasath (Village Administrative Officer) as he is the Class II legal heir of the deceased.

On 14.02.2025, the petitioner submitted a representation to the 2nd respondent requesting the disbursal of the entire death-cum-retirement benefits, including the pensionary benefits of the deceased N. Prasath. As there was no positive response, the petitioner sent a reminder and a further representation on 28.07.2025. However, no action has been taken till date. Hence, this Writ Petition.

4. Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondents.

Taking into consideration the facts and circumstances of the case, the 2nd respondent is directed to consider the representations of the petitioner, dated 14.02.2025 and 28.07.2025 and pass appropriate orders on merits and in accordance with law, within a period of 8 weeks from the date of receipt of a copy of this order. It is made clear that this Court has not made any observation with regard to the merits or claims of the petitioner.
