ORDER

The petitioner seeks a direction to the respondent Police to give non traceable certificate in view of missing certain original documents by considering his representation dated 20.08.2025. .

2. It is the case of the petitioner that he borrowed a sum of Rs.2,00,000/- from the second respondent by handing over the original title deeds of his property as security. However, the second respondent lost the said documents while he shifted his residence. Hence, he lodged a complaint to the respondent police seeking non traceable certificate.

3. It is relevant to note that such non traceable certificate are required only for transaction before the Registering authority. Now a circular has been issued by the Inspector General of Registration in letter No.44420/C1/2024, dated 28.04.2025, wherein it is clearly held that Rule 55-A of the Registration Rules was struck down by the Supreme Court. It is further held that the Registration Officers shall not insist for production of original previous

documents or non-traceable certificate from the Police Department or encumbrance certificate and other revenue details from the registrants.

4. In view of the above circular, non-traceable certificate from the Police is not at all required. Accordingly, this petition is disposed of. 24-09-2025 pvs Index:Yes/No Speaking/Non-speaking order Internet:Yes
