Civil Revision Petition filed under Article 227 of the Constitution of India, to issue direction to the learned First Additional District Judge, Salem to dispose of A.S.No.78 of 2020 within a time frame fixed, by allowing this Civil Revision Petitoin.

O R D E R
The plaintiffs in O.S. No. 49 of 2010 before the Sub Court, Sankari, are the revision petitioners, seeking expeditious disposal of the appeal suit in A.S. No. 78 of 2020 pending before the I Additional District Court, Salem.

The learned counsel for the petitioners states that the suit was filed for partition and the relief of permanent injunction way back in the year 2010, and after contest, the suit was decreed on 18.08.2020, and the preliminary decree has been passed in favour of the revision petitioners. Respondents 1 to 4 have filed the appeal suit in A.S. No. 78 of 2020, which is pending before the I Additional District Court, Salem, for the past five years; the petitioners are seeking expeditious disposal of the said appeal.

3. Considering the limited relief sought for in this civil revision petition, notice to the respondents is dispensed with. The petitioners are senior citizens, and they have filed the suit for declaring their shares in the suit properties even in the year 2010, and after a decade from the suit being decreed, and the preliminary decree was granted, the first appeal is pending for over five years now.
4. In view of the above, the I Additional District Court, Salem, is directed to dispose of the appeal suit in A.S. No. 78 of 2020 on merits and in accordance with law, on or before 31.01.2026.
5. In the result, this Civil Revision Petition is allowed as indicated above. No costs.
