O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 303(2), 326(a) of BNS Act, 2023, in Crime No. 341 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner had transported 1/4 unit of river sand by using bullock cart without any valid permission from the Government of Tamil Nadu. Hence the respondent police registered a case against the petitioner.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and submits that the petitioner had illegally transported quarter unit of river sand by using bullock cart without any valid permission from the Government of Tamil Nadu. Therefore, he strongly opposed for grant of anticipatory bail to the petitioner.

5. Taking into the fact that the petitioner had transported huge quantity of river sand from river bank without any valid permission from the Officials of the Government, the gravity of offence was committed by the petitioner herein and the investigation in this case is yet to be concluded, at this stage, this Court is not inclined to grant anticipatory bail to the petitioners.
