ORDER
The present writ petition has been filed seeking a Writ of Mandamus, directing the 1st respondent to consider the representation of the petitioner dated 01.09.2025 and consequently to direct the 1st respondent to expeditiously dispose the MSEFC/CR/150/2024 pending on the file of the 1st respondent.
2. Heard Mr.G.M.Gokul Ram, learned counsel for the petitioner and Mr.Shajahan, learned Special Government Pleader for the respondent.
3. The petitioner is running a business in manufacturing aluminium alloyed ingots from scraps. She had contracted with the second respondent for supply of ADC12 grade Aluminium Alloy. The supplies were made in the year 2021. Despite the demands for payment, the second respondent did not release the same.

The petitioner being registered as an MSME, invoked the provisions of the Micro, Small, Medium Enterprises Development Act, 2006 and filed an application for recovery of the amount in terms of the said Act. The application was received and registered in MSEFC/CR/150/2024 and the hearing date was fixed to 16.06.2025. As no progress was made in the proceedings, she is before this Court for the aforesaid relief.

Being a statutory duty of the first respondent to dispose of the case in terms of the Act, I requested Mr.Shajahan to get instructions from the first respondent as to how long it will take for the first respondent to dispose of the aforesaid proceedings. Mr.Shajahan, reports that approximately around 1,500 cases are pending and the first respondent had instructed him that it will take not less than four months to dispose of the proceedings, which is the subject matter of the writ petition. Hence, the writ petition is disposed of on the following terms:
1. The first respondent shall dispose of the proceedings within four (4) months from today i.e., on or before 26.01.2026.

2. The time limit having been fixed on instructions, it shall be treated as an undertaking given by the 1st respondent to this Court. In case, the time limit is not adhered to, it is open to the petitioner to initiate contempt proceedings.
3. The time limit fixed under this order will not be enforced by the first respondent, in case, the petitioner seeks for an adjournment. In other words, the petitioner should be ready to proceed with the case on all dates of hearing. This direction is given because the case of the petitioner is to be taken out of turn and directed to be disposed of.
