The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 294(b),406,498(A) and 506(ii) of I.P.C in Crime No.82 of 2023, seeks anticipatory bail.

2. The case of the prosecution that the defacto complainant is the wife and the petitioner is the husband. It is stated that petitioner had illegal intimacy with his uncle's wife. It is also contended that at the time of marriage 151 soverigns of gold jewels, Cash Rs.15,00,000/- and some house hold articles were presented to the defacto complainant. While so the petitioner's family demanded more dowry from the defacto complainant.

3. The learned counsel for the petitioner submitted that anticipatory bail application was filed by the petitioner before the Court below and the same was dismissed. He further submitted that the defacto 1/3

complainant and her family members questioned about the potency of the petitioner, due to which, the petitioner underwent various tests and the report revealed that the petitioner is a healthy person. He further submitted that necessary application was filed before the Court below for grant of divorce.

4. Considering the nature of offence committed by the petitioner, this Court is of the view that the matter requires further investigation. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.

5.Accordingly, this Criminal Original Petition stands dismissed.
