: Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue Writ of Mandamus, directing the respondents to disburse the petitioner's differential sum of Gratuity based on dearness allowance revision with effect from 01.07.2019 with interest at the rate of 8% per annum from the said date of entitlement to till the date of actual disbursement within a time limit to be stipulated by this Court.

ORDER

This writ petition has been filed for a direction directing the respondent to disburse the differential sum of gratuity based on dearness allowance revision with effect from 01.07.2019 with interest.

2.The petitioner was working as Special Grade Driver in the Tamil Nadu State Transport Corporation (Villupuram) Ltd., Vellore Region and retired from service on 31.07.2019. The transport employees were granted dearness allowance at 12% of basic pay as on 01.01.2019. However, with effect from 01.07.2019, it was revised to 17 % of basic pay. Since the petitioner retired from service on 31.07.2019, his retirement benefits required to be revised and he is entitled for arrears of dearness allowance.

3. In view of the above, the respondents are directed to consider the case of the petitioner and disburse the eligible amount as applicable to the petitioner with interest at the rate of 6% per annum, within a period of 12 weeks from the date of receipt of a copy of this order.
