.... Respondents Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the respondents 1 and 2 to restore the patta bearing No.220 in respect of land measuring 320 sq.mtrs. comprised in S.No.59/34 or Sithadi Village, Kuduvasal Taluk, Thiruvarur District in terms of order passed by the third respondent in his proceedings dated 17.02.2025 in Ne.Mu.8149/2024/B1 by passing order on the petitioner's representation dated 01.07.2025. 1/4

ORDER
This writ petition has been filed seeking issuance of a writ of mandamus directing the respondents, particularly, the second respondent to restore the patta of the petitioner with respect to the subject property in terms of the order passed by the third respondent through proceedings dated 17.02.2025.
2. Heard Mr.Manoharan S Sundharam, learned counsel for petitioner and Mr.S.Rajesh, learned Government Advocate appearing for respondents.
3. The petitioner is the owner of the subject property measuring an extent of 320 sq.mts. by virtue of a settlement deed dated 13.06.2022. Patta was also issued in favour of the petitioner. Since the rival party attempted to interfere with the possession and enjoyment of the property, the petitioner filed a suit in O.S.No.47 of 2023 before the District Munsif Court, Nannilam. This suit was transferred to the file of District Munsif Court, Kudavasal and re-numbered as O.S.No.102 of 2024 and it is 2/4
pending. In the mean time, the second respondent cancelled the patta by order dated 17.02.2025. Aggrieved by the same, the petitioner's brother had filed an appeal before the third respondent with respect to cancellation of patta which stood in his name. The third respondent set aside the order of the second respondent and the patta was restored insofar as the petitioner's brother is concerned. The grievance of the petitioner is that patta ought to have been restored in his name by virtue of the order passed by the third respondent. A representation was also submitted by the petitioner in this regard on 01.07.2025. Since the same did not evoke any response, the present writ petition has been filed.
4. Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the second respondent to act upon the representation made by the petitioner dated 01.07.2025 in line with the order passed by the third respondent dated 17.02.2025 and do the needful within a period of four
(4) weeks from the date of receipt of a copy of this order. N.ANAND VENKATESH, J.
