The petitioner, who was arrested and remanded to judicial custody on 07.11.2024 for the offences punishable under Sections 8(c) r/w 20(b)(ii)(C), 25 and 29(1) of NDPS Act, 1985 in Crime No.54 of 2024, registered on the file of the respondent police, seeks bail. The earlier bail application of the petitioner was dismissed by this Court, vide order dated 04.09.2025 in Crl.O.P.No.11874 of 2025.

The case of the prosecution is that the petitioner herein entered into conspiracy with other accused and illegally transported 42 kilograms of ganja in a lorry bearing Registration No.TN-84-Z-6923 from Andhra Pradesh. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner was falsely implicated in this case and he is in judicial custody since 07.11.2024 and the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Crl. Side) appearing for 2/4

the respondent while opposing the bail to the petitioner reiterated the prosecution case and stated that total quantity of contraband involved in this case is 42 kilograms of ganja, which is a commercial quantity; that the statement of the petitioner as well as A1 disclosed their culpability in the crime; and that the investigation is pending. 5.

Considering the facts of the case, the present bail petition is filed immediately after the dismissal of the earlier bail application of the petitioner by this Court, vide order dated 04.09.2025 in Crl.O.P.No.11874 of 2025 and there is no change of circumstances after the dismissal of the earlier bail petition and also the fact that the investigation of the case is pending, this Court is not inclined to grant bail to the petitioner. 6.

Accordingly, this criminal original petition stands dismissed. 06.10.2025 stn K. RAJASEKAR, J.
