This civil miscellaneous petition is filed seeking to condone the delay of 371 days in filing the appeal.

Learned counsel for the petitioners/appellants submitted that notice to the 1st respondent may be dispensed with, since he remained ex-parte before the Tribunal and he has also made an endorsement to that effect. Hence, notice to the 1st respondent is dispensed with.

3. Heard the learned counsel for the petitioners/appellants and the learned counsel for the 2nd respondent.

4. Sufficient reasons have been given in the affidavit filed in support of the petition. Accordingly, the delay is condoned and the petition is ordered.

It is made clear that the petitioners/appellants will not be entitled for any interest for the delay period of 371 days.

6. Registry is directed to number the civil miscellaneous appeal, if it is otherwise in order and list the same for admission.
