Petition filed under Article 226 of the Constitution of India to 1/5
issue a Writ of Certiorarified Mandamus calling for the records pertaining to the order dated 30.08.2024 vide Na.Ka.No.A1/0010/ 2024 issued by the fourth respondent and quash the same and consequently issue direction directing the respondents 1 to 4 to take necessary actions to fix the correct age of the fifth respondent through scientific method and to take action against the fifth respondent in accordance with law for having furnished the false date of birth.

The petitioner has filed this writ petition seeking issuance of Writ of Certiorarified Mandamus calling for the records pertaining to the order dated 30.08.2024 vide Na.Ka.No.A1/0010/2024 issued by the fourth respondent and quash the same and consequently issue direction directing the respondents 1 to 4 to take necessary actions to fix the correct age of the fifth respondent through scientific method and to take action against the fifth respondent in accordance with law for having furnished the false date of birth. 2/5
2.The learned counsel appearing for the petitioner submitted that the petitioner is the Vice President of Nathamalai Village Panchayat. The fifth respondent claiming that he is employed as Over Head Tank Operator filed complaint seeking arrears of salary, pursuant to which, the fourth respondent issued direction to the President of Nathamalai Village Panchayat to pay arrears from 21.04.2024. The learned counsel further submitted that above 60 years no one can be employed as Over Head Tank Operator and after retirement the fifth respondent claim arrears of salary from the Panchayat, which is not sustainable one.
3.The learned counsel appearing for the fifth respondent submitted that the fourth respondent issued impugned communication to the Panchayat President who is the Executive Authority of the Village Panchayat. Petitioner is not the Executive Officer and he is only Vice President and no communication is issued to the petitioner, even then the petitioner has filed this writ petition. 4.Perusal of records disclose that the impugned communication has been issued to the Panchayat President and 3/5
petitioner is only Vice President and no communication is issued to the petitioner. Hence, the petitioner filing writ petition is not sustainable one.
5.The writ petition is dismissed. No costs. Consequently, the connected miscellaneous petition is closed.
