Ajmal v. The State Rep.By
Crl.O.P.No.28582 of 2023 C.V.KARTHIKEYAN,J.
The petitioner is A4 in C.C.No.203 of 2019, now pending before the District Munsif cum Judicial Magistrate Court, Uthukuli, seeks bail. Originally, Crime No.42 of 2018 had been registered for the offence under Sections 457 & 380 of IPC.
2.The petitioner did not appear before the Court on 04.08.2023 and a Non-bailable Warrant was issued and the petitioner was secured only on 05.11.2023. There were two earlier occasions when the petitioner had similarly absconded from appearing before the Court, necessitating issuance of NBW. 3.It is stated that the matter is now posted for examination of the Investigating Officer. If the learned counsel for the accused co-operates then the trial can be reasonably completed and therefore, a direction is given to the Trial Court, if there is co-operation from the learned counsel for the accused, to complete the trial on or before 31.01.2024.
4.In view of all these facts, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed. 21.12.2023 ata 1/2 https://www.mhc.tn.gov.in/judis
