ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.

2. This case is registered in Crime No. 92 of 2009 for alleged offences under Section 147, 148, 452, 326 and 307 r/w 149 of Indian Penal Code, 1860. Page No.1 of 3

The incident occurred on in the year 2009. The mother's case in S.C.No. 112 of 2018 proceeded further and resulted in an acquittal. The grounds for acquittal also apply to the present accused. The matter has been pending for execution of the warrant for long time.

3. Considering the factual matrix, the context of the case, the background of the accused, the reason for his absence at his place of residence, and the submission made that, despite best efforts, the warrant could not be executed, it is clear that even if the accused faces trial, no useful purpose would be served.

4. Accordingly, the case in P.R.C.No. 58 of 2017 on the file of VIII Metropolitan Magistrate Court, George Town Taluk, Chennai shall stand quashed and this Suo Motu Transfer Case stand disposed of. 24.09.2025 nsl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
