Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the second respondent to issue necessary direction to 3rd and 4th respondents and District Recruitment Bureau of all other districts to fill up the post of Salesman and Packers either by deputation or on the basis of absorption on permanent basis from parent society to other society first as per 2nd respondent instruction issued vide Na.Ka.No.72410/2022/PDS M1 dated 21.11.2022 before venturing into selection and appointment of Salesman and Packers directly as per notification No.1/2024 dated 09.10.2024 of 3rd and 4th respondents and similar notification of District Recruitment Bureau of other districts. The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the second respondent to issue necessary direction to the respondents 3 and 4 and District Recruitment Bureau of all other districts to fill up the post of Salesman and Packers either by deputation or on the basis of absorption on permanent basis from parent society to other society first as per the second respondent's instruction issued vide Na.Ka.No.72410/2022/PDS M1 dated 21.11.2022 before venturing into selection and appointment of Salesman and Packers directly as per notification No.1/2024 dated 09.10.2024 of respondents 3 and 4 and similar notification of District Recruitment Bureau of other districts.
2.The learned counsel appearing for the petitioner submitted that the petitioner joined as Salesman at the sixth respondent society on 26.02.2019. The petitioner is hailing from Tuticorin District. Since the sixth respondent society is far away from his native place, the petitioner made representation to the sixth respondent to transfer him to the seventh respondent society on permanent absorption during June, 2024 and the sixth respondent passed necessary resolution during August, 2024 and the same was forwarded to the fifth 3/6
respondent for necessary action, whileso, the respondents 3 and 4 and all other District Recruitment Bureau issued notification for direct recruitment to the post of Salesman and Packers in the fair price shops run by the societies and aggrieved by the same, the petitioner has filed this writ petition.
3.The learned counsel appearing for the petitioner further submitted that though the petitioner has sought for a larger relief, it would suffice, if this Court permits the petitioner to make fresh representation to the fifth respondent on the basis of the resolution passed by the sixth respondent for absorbing the petitioner in the seventh respondent society.
4.Considering the limited relief now sought for by the learned counsel appearing for the petitioner, this Court, without expressing any opinion on the merits of the case, grant liberty to the petitioner to make fresh representation to the respondents in terms of G.O. (Ms).No.108, Co-operation, Food and Consumer Protection (C.J1) Department dated 23.09.2023. On receipt of such representation being made by the petitioner, the respondents 5 to 7 shall consider the same and pass appropriate orders, as expeditiously as possible. 4/6
