Vijayan @ Salavedu Babu v. The Inspector Of Police

2024-01-08Honourable Mr Justice C.V. Karthikeyan3 pages

C.V.KARTHIKEYAN , J.

The Petitioners/A2, A3, A4 and A5 seek anticipatory bail in Crime No.303 of 2023 registered by the Respondent Police for the offences under Sections 147, 294(b), 506(ii), 507, 509, 109 IPC read with Sections 67, 67(A) of Information Technology Act, 2000.

2. The learned counsel for the Petitioners stated that the Accused A1 had been arrested and had been granted bail. He also stated that an offensive poster had been put up on 24.11.2023 and the complaint had been lodged on 30.11.2023. He therefore stated that there is a delay in lodging of complaint and registration of First Information Report.

3. In the counter affidavit filed by the Respondent, it is seen that they had examined six witnesses and had recorded their statements. But the nature of the complaint is quite serious that the Accused had put up a poster in a social media stating that the defacto complainant, could be approached for favourable relationship on payment of money. 1/3

4. The nature of the complaint whoever be the defacto complainant is very disgusting. I am not inclined to grant anticipatory bail to the Petitioners herein. Accordingly, this Criminal Original Petition stands dismissed.
