CMP.Nos.29218, 29220 & 29221 of 2023 in A.S.Nos.488 of 2020 and 837 of 2012 RMT.TEEKAA RAMAN,J., These Civil Miscellaneous Petitions are filed (i) to condone the delay of 40 days in filing the petition to set aside the abatement caused due to the death of the 8th respondent - Rajakumaran (ii) to set aside the abatement caused due to the death of the 8th respondent and (iii) to bring the proposed respondents herein as the rank them as 10 to 14 legal representatives of the deceased 8th respondent on record in the above Appeal Suit.

2.Heard both sides. The factum of the death of the 8th respondentRajakumaran, in the Appeal Suit and their legal representatives are not in dispute.

3.Considering the submissions made on behalf of the learned counsel for the petitioner, and being satisfied with the reasons stated in the affidavits filed in support of these petitions, all these petitions are allowed as prayed for.
