ORDER

The petitioner, who was arrested and remanded to judicial custody on 08.09.2025, for the offences punishable under Sections 296(b), 115(2), 351(2) of BNS @ Sections 296(b), 115(2), 351(2), 75(2) of BNS and Sections 7 r/w 89, 92(b) Rights of Persons with Disabilities Act, 2016 in Crime No.482 of 2025, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that, while the defacto complainant, who is a physically challenged person went along with one woman to a hotel room, the accused person taken videograph of them, started blackmailing the defacto complainant and asked him to come near bus stand; that thereafter the accused along with petitioner herein taken the defacto complainant to a deserted place and started abusing the defacto complainant, assaulted, forced him for unnatural sex and also threatened him of dire consequences. Hence, this case.

The learned counsel appearing for the petitioner submitted that a false complaint has been lodged against the petitioner due to political 2/4

dispute and the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner. 4.

The learned Government Advocate (Criminal Side) appearing for the respondent police while opposing the bail to the petitioner, reiterated the prosecution case and states that the mobile phone of the accused were seized, the medical examination report of the victim is yet to be received; and that the investigation is at earlier stage. 5.

Considering the facts, grave nature of offence and taking note of the fact that the investigation is at initial stage, this Court is not inclined to grant bail to the petitioner.

Accordingly, this criminal original petition is dismissed. 23.09.2025 stn 3/4
