O R D E R

The petitioners herein, who were arrested on 17.08.2025 for the alleged offence punishable under Sections 8(c), 20(b)(ii)(C), 25, 29(1) of 1/5

NDPS Act, 1985 in Crime No.153 of 2025 on the file of the respondent, seeks bail.

2.The allegations against these petitioners are that the petitioners joining hand with the other accused had transported Ganja through train from Bihar to Erode and the police came to know about the activity of this group, they had intercepted A1, and from him 10.5 Kgs of Ganja was recovered. Subsequently, on the confession of A1, A2 was identified, who was working as a porter in the railway station and from him another 10.5 kgs of Ganja was recovered. Based on the identification of A1 and A2, the police had intercepted these petitioners herein and from them 3 kgs of Ganja was recovered and subsequently, further revealed that there are some more persons involved in this case and they have also been arrested and recovery was effected. The total quantity of contraband involved in this series of event is about 30 Kgs. Hence, the case.

3.The learned counsel appearing for the petitioners submitted that the petitioners are ladies and only 3 kgs of Ganja was recovered from these petitioners and they shall not be considered with the other accused. Hence, he prays to grant bail to the petitioners.

4.The learned Government Advocate (Crl. Side) appearing for the respondent reiterated the prosecution case and submitted that the accused persons were acting as a network and jointly transporting Ganja from Bihar to Erode through train. Hence, he opposed to grant bail to the petitioners. 5.Heard both sides.

6.I have considered the submissions made on both sides. On perusal of the record it reveals that the series of events of search and arrest done by the police culminated into recovery of 30 kgs of Ganja. The statements recorded from the petitioners would reveal that they are all one group and there is no possibility of dissecting the quantity recovered from each accused person to grant bail and the entire quantity is to be taken into consideration for granting of bail to the petitioners. Therefore, Section 37 of NDPS Act applicable to this case and no grounds are raised for satisfying the conditions stipulated under Section 37 of the NDPS Act. Accordingly, this Criminal Original Petition stands dismissed. 23.09.2025 smv 3/5
