The petitioner seeks bail in Crime No.26 of 2023 registered by the respondent police for the offences punishable under Sections 366,363 of I.P.C and 5(1) r/w 6 of POCSO Act 2012.

2. It is stated that a complaint had been lodged before the respondent that the daughter of the defacto complainant was missing. Thereafter, it was found that the victim girl and the accused had gone to Tirupathi, Vijayawada, Vishakapatinam and stayed together. It is stated that the petitioner is a married person and he was seperated from his wife. It is stated that investigation has been completed and final report has been filed and but not taken cognizance.

3. Taking into consideration the fact that the petitioner had been earlier married and thereafter had committed offence under section 5(1) of r/w 6 of POCSO Act 2012, I am not inclined to grant bail to the 1/3

petitioner. This Criminal Original petition stand dismissed. However, a direction is issued to the Sessions Judge, Principal POCSO Court, Salem to take cognizance of the final report, if the final report is otherwise in order.
