Order This Transfer Civil Miscellaneous Petition is filed under section 24 of CPC to transfer I.D.O.P. No.4134 of 2024, from the file of the 1st Additional Family Court, Chennai to the file of V Additional Judge Family Court at Chennai.
2. Today, when the matter is taken up for hearing, there is no representation for the petitioner. Learned counsel for the respondent is present.
3. Both the courts between which transfer is sought are within the same District Judiciary. Under Section 24 CPC, the Principal District Judge is competent to consider transfers between courts subordinate to that District Court. No special or exceptional ground has been shown for invoking the High Court's jurisdiction at the first instance when an efficacious, co-ordinate statutory remedy before the Principal District Judge is available. On this short ground, the petition is not entertained.
4. Accordingly, TR.C.M.P. No. 1073 of 2025 is dismissed with liberty to the petitioner to move the Principal District Judge, in accordance with law. Consequently, connected C.M.P.No.24180 of 2025 is also dismissed. No costs. 05-02-2026 Index: Yes/No Speaking/Non-speaking order SHL
