ORDER

This Writ Petition has been filed for a direction directing the respondents not to proceed with the construction of water supply over Head Tank on the patta lands of the petitioner in Survey Nos.1061, 1065 and 1057 in Alsanatham village, Chennathur village and post, Hosur taluk, Krishnagiri district more fully described in the schedule without acquiring the land under Land Acquisition Act by paying the compensation as per the statute.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. On instruction, the learned Special Government Pleader appearing for the respondents 1 to 3 would submit that already the construction of over head tank was completed and it has been came for usage of the general public. That apart, the over head tank has been constructed in the land comprised in Survey No.1058 and it has been classified as 'Poramboke' land situated at Alsanatham Village.

4. Admittedly, the petitioner's land situated in the Survey Nos.1061, 1065 and 1057. No construction was made in the petitioners patta land situated at the Alsanatham Village.

5. Recording the said submissions, this Writ Petition stands closed. No costs. Consequently, the connected miscellaneous petitions are closed. 26.09.2024 Jer
