This miscellaneous petition has been filed to condone the delay of 40 days in filing the appeal.

2. Heard the learned counsel for the petitioner. Though notice has been served on the respondent, learned counsel for the respondent is not present.

3. Considering the submission made by the learned counsel for the petitioner and on being satisfied with reasons stated in the affidavit, this Court is of the view that the delay may be condoned. Accordingly, the delay is condoned and this petition stands allowed.
