This petition has been filed seeking to condone the delay of 61 days in filing the application to set aside the order dated 29.08.2024 made in W.P.No.9668 of 2010.

2. Though notice was served and the name of the 2nd respondent was printed in the cause list, none appeared on his behalf.

3. Heard learned counsel for the petitioner.

4. Being satisfied with the reasons stated in the affidavit filed in support of the petition, this Court is inclined to order this petition.

5. Accordingly this petition is allowed. Registry is directed to number the set aside application, if it is otherwise in order and post the matter in the usual course.
