This Writ Petition has been filed challenging the order passed by the 3rd respondent dated 23.12.2024 and thereby rejecting the request made by the petitioner to sub-divide and modify the patta in respect of the property comprised in S.No.473/2015 situated at Panchamadevi Village, Villupuram District.
2. Heard the learned counsel appearing on either side and perused the materials available on record.

A perusal of the impugned order revealed that, in respect of the subject property as well as other properties, a suit has been filed by one Mr.Subburama Naidu against the petitioner and others seeking a declaration. Therefore, pending the said suit, the request for sub-division of the subject property cannot be considered, and hence the respondent rejected the petitioner's request.
4. The learned counsel for the petitioner would submit that the sole plaintiff, Mr.Subburama Naidu, who had filed the suit, is no more. That 2/5
apart, the suit has been filed in respect of the common property and not the subject property alone.

On instructions, Mr.D.Ravichander, learned Special Government Pleader appearing for the respondents submitted that the petitioner had sought sub division and issuance of patta in respect of the subject property and since a suit is pending in respect of the very same property, the 3rd respondent has rejected the request of the petitioner. Now the sole plaintiff, the said Subburama Naidu died and the suit is pending for impleading his legal representatives. If at all, the legal representatives have no objection for the sub division and issuance of patta in respect of the subject property, the 3rd respondent can very well sub divide the subject property and issue patta in favour of the petitioner.
6. Accordingly, the petitioner is directed to submit a fresh application for sub division and issuance of patta in respect of the subject property. On receipt of the same, the 3rd respondent is directed to issue notice to the legal representative of the deceased Subburama Naidu and conduct an enquiry after giving opportunity to both parties and thereafter pass appropriate orders on merits and in accordance with law. 3/5
7. With the above directions, the Writ Petition is disposed of. No costs.
