O R D E R
The petitioner herein, who was arrested on 29.01.2025 for the alleged offence punishable under Section 8(c) r/w 20(B)(ii) (C), 25, 29(1) of Narcotic Drugs and Psychotropic Substances Act, 1985 in C.C.No.516 of 1/6
2025 on the file of the II Additional Special Court for Exclusive Trial of Cases under NDPS Act, Chennai, seeks bail.
2.The case of the prosecution is that the petitioner along with other accused were illegally transported of 150 kgs of Ganja (Commercial Quantity). Hence the case.
3.The learned counsel appearing for the petitioner submitted that no contraband was recovered from this petitioner and a false case has been foisted against the petitioner and the petitioner is no way connected with the alleged offence. Hence, he prays to grant bail to the petitioner. 4.The learned Government Advocate (Crl. Side) appearing for the respondent reported that this petitioner is ranked as A1 and he acted as a gang leader and engaged the other accused persons to transport the contraband. He further submitted that the respondent police intervened A2 and A3 and recovered 150 kgs of Ganja from them and on the basis of statements recorded from them, two other accused were also implicated in this case. He submitted that there are 17 previous cases pending against the petitioner, out of which 4 cases are under NDPS Act. Hence, he opposed to grant bail to the petitioner.

6.Though it is contended by the learned counsel for the petitioner that no recovery has been effected from this petitioner, the statement recorded from the co-accused and as well as the recovery effected from them, would show that this petitioner also involved in the alleged offence. Section 37 of NDPS Act is applicable to this case and no grounds made to satisfy twin conditions of Section 37.
7.Taking all the factors into consideration and considering the bad antecedents of the petitioner and also the fact that there are 17 previous cases pending against the petitioner, out of which 4 cases are under NDPS offence, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
