ORDER
The petitioner who apprehends arrest pursuant to non bailable warrant issued on 04.10.2024 in S.C.No.23 of 2022 by the learned IV Additional Sessions Judge, Chennai seeks anticipatory bail.
2. The learned counsel for the petitioner would submit that the petitioner was sick and he was unable to appear before the Court on 04.10.2024 and thereby, the Court
had issued non-bailable warrant of arrest against him. Therefore, the petitioner seeks for anticipatory bail.
3. Learned Government Advocate would submit that the petitioner is a habitual offender. He did not appear before the Court on 04.10.2024 and thereby, the learned trial Judge had issued non bailable warrant of arrest against him. The option available to the petitioner is to surrender and apply for recalling the warrant.
4. In view of the above, direction is issued to the petitioner to surrender before the Court within two weeks and file an application seeking recall of warrant. The learned Judge shall pass orders on the same day of surrender.
