Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue Writ of Mandamus, directing Respondents 1 to 4 to duly consider the Petitioner's representation dated 3rd April 2025 and further directing respondents 1 to 3 not to issue any promotion orders for the positions of Sub Registrar Grade-1, Sub Registrar Grade-2, and District Registrar, Assistant General of Registration until the resolution of the Petitioner's representation dated 3.04.2025.

ORDER

Mr. U. Baranidharan, learned Special Government Pleader takes notice for the respondents. By consent of both the parties, this writ petition is taken up for final disposal at the admission stage itself.

2. The petitioner was initially appointed as Junior Assistant in the Registration Department on 28.08.2000 and is presently serving as SubRegistrar Grade-II at Uthukuli, Thiruppur District.

It is the grievance of the petitioner that some irregularities were found in fixation of seniority for the purpose of promotion to higher posts, viz., Sub Registrars (Grade I and II), District Registrar and Assistant Inspector General of Registration. The petitioner submitted a detailed representation dated 2/5

03.04.2025 to the respondents, wherein his grievances were exhaustively stated and requested for rectification of the seniority position.

The petitioner's further prayer is to issue appropriate directions to respondents 1 to 3 refraining them from issuing any promotion orders to certain posts viz., Sub Registrars (Grade I and II), District Registrar and Assistant Inspector General of Registration, till the disposal of the representation submitted by the petitioner on 03.04.2025. As the said representation dated 03.04.2025 has not been considered by the respondents, this writ petition has been filed.

5. Learned counsel for the petitioner would submit that due to improper fixation of seniority in certain posts by the respondents, irreparable loss has been caused to the petitioner and others.

Though an exhaustive prayer is sought, at the time of arguments, learned counsel for the petitioner submitted that it would suffice, if this Court issues a direction to the respondents to consider the petitioner's representation dated 03.04.2025, within a time frame and not to issue promotion orders to the aforesaid posts till such time.

7. Replying to the aforesaid submission, Mr.U. Baranidharan, learned Special Government Pleader appearing for the respondents would submit that 3/5

the petitioner's representation dated 03.04.2025 will be considered effectively. However, he submitted that nonissuance of promotion orders would hamper the administrative work to a great extent.

8. In view of the above, he has no objection for issuance of suitable directions to dispose of the petitioner's representation, within a time frame to be stipulated by this Court.

9. In view of the fair stand taken by the learned counsel on either side, this Court directs the respondent concerned to consider the petitioner's representation, dated 03.04.2025, and pass orders on its own merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any opinion with regard to the claim of the petitioner.
