ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The contempt petition has been instituted under Section 10 of the Contempt of Courts Act, 1971, to punish the respondents for their wilful

disobedience of the orders passed by the learned Judicial Magistrate, Ambattur on 05.08.2023 in CMP.No.4037 of 2022.

The learned Magistrate passed the docket order that the subject case is related to temple property and temple funds, which is falling under the purview of HR & CE Department. However, in the interest of justice and to ascertain the nature of case, Station House Officer, T-8, Muthapudupet Police Station was directed by the learned Judicial Magistrate to conduct an enquiry and file a report.

Such an order would not provide a cause for institution of contempt proceedings. Court wanted to know the nature of case with reference to the allegations set out in the petition. Therefore, directed the Station House Officer to conduct an enquiry and file a Report. That being the scope of the order, the present contempt petition filed is not enternainable and the same stands dismissed.
