This Criminal Original Petition has been filed to quash the final report in C.C.No.151 of 2022, filed for the offences under Sections 147 and 294(b)
of IPC and Section 4(1)(j) of Tamil Nadu Prohibition Act, pending trial on the file of the learned Judicial Magistrate, Virudhachalam.
2. The allegation against the petitioner is that the petitioner in an intoxicated state, caused nuisance to the public in a moving express train.
3. Though various grounds were made by the learned counsel for the petitioner, now it is stated that more than five witnesses have already been examined and substantive evidence has come on record.
4. In such view of the matter, it is for the Magistrate to appreciate the evidence and to decide the case on merits. Therefore, this Court is not inclined to entertain this petition.
