ORDER

This application has been filed to permit the applicant to withdraw the sum of Rs.47,84,144/- with accrued interest, which was deposited by the petitioner during the pendency of the Arb.OP No.134 of 2024.

Heard the learned counsel for the petitioner and carefully perused the materials available on record.

It is seen that Arb OP No.134 of 2024 was filed by the applicant challenging the arbitral award dated 10.11.2023 passed by the sole arbitrator. At the time of filing of the petition, as per the mandate provided under the MSMED Act, 75% of the amount was deposited by the applicant. Ultimately, the award came to be setaside by this Court by an order dated 26.06.2025. In view of the same, the present application has been filed for withdrawal of the

amount that was deposited by the applicant.

The certificate issued by the Joint Registrar (OS) shows that a sum of Rs.49,84,144.00/- is lying in the Fixed Deposit to the credit of Arb OP (Com.Div) No.134 of 2024, which was renewed on 11.06.2025 with Indian Bank, High Court Branch for a period of one year, which carries interest at the rate of 6.10 % per annum. 5.

The petitioner is permitted to withdraw the sum of Rs.49,84,144.00/- with accrued interest.

This application is disposed of in the above terms. No costs.
