This Civil Miscellaneous Petition has been filed to condone the delay of 226 days in filing the above appeal.

2. Heard the learned counsel for the petitioner.

kkd Company and he has no serious objection, provided the interest for the delay period is waived.

3. The petitioner would aver that owing to the grievous injuries sustained in the accident, he was under continuous medical treatment and has been facing financial constraints. Hence, delay of 226 days occurred in filing the Civil Miscellaneous Appeal.

4. Accepting the reasons assigned by the petitioner appear to be acceptable and reasonable, this Court is inclined to allow this petition, subject to the condition that the interest for the delay period of 226 days shall stand waived.
