Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, directing the respondents herein to take immediate steps to provide proper road and street light facilities in the existing cart track that has been running north to south by branching off from the Thekkalur Village Main Road and running between the survey Nos.570 and 571, Thekkalur Village, Avinashi Taluk, Tiruppur District for their beneficial user forthwith. ORDER

(Made by the Hon'ble Chief Justice) Heard Mr.D.Krishna Pradeep, learned counsel appearing for Mr.N.Damodaran, learned counsel for the petitioner and Mr.P.Muthukumar, learned State Government Pleader for respondents 1 to 8.

2. Learned counsel for the petitioner submits that the cart track is available, but there are no facilities for proper road and lights.

3. The factual matrix will have to be considered by the concerned authorities, that is, the existence of the public cart track and other aspects of the matter.

4. The petitioner has given a representation to the authorities in the month of March, 2022. In case the representation is given by the petitioner to the authorities concerned, then the authorities shall consider the said representation, on its own merits and in accordance with law, after considering the actual situation and take a decision preferably within a period of six months.

5. In light of the above, the writ petition stands disposed of. There shall be no order as to costs.
