ORDER

This writ petition is filed seeking for a mandamus directing the respondents to issue patta in favour of the petitioner by considering the petitioner's online patta application dated 11.10.2023. It is submitted by the learned counsel for the petitioner that the petitioner has purchased 10 cents of land in survey nos. 49/5F and 45/5H dated 05.05.2014 vide document No.1094 of 2014 at S.R.O. Gingee. The said property is a part of the layout and patta has already been issued to other plot owners by the respondents. The petitioner has been requesting to issue patta in his name for the last five years. However, the respondent has failed to consider the request of the petitioner. The petitioner has also approached the Human Rights Commission with the same request. Ultimately, he has filed an application before the Deputy Collector dated 27.10.2017 who has directed the concerned authorities to consider the request of the petitioner 2/6

but even then there was no response from the respondents. Finally, the petitioner has filed an online application dated 11.10.2023. In response to the said online application enquiry was initiated. The petitioner was directed to attend the enquiry on 16.02.2022 vide proceedings in Na.ka.No.A2/4616/2019 and accordingly, the petitioner attended the enquiry along with all the relevant documents. Again on 11.04.2022 the petitioner was directed to attend enquiry at the SRO with all the relevant documents on 10.05.2022 and accordingly, he attended with all the relevant documents. Even though the petitioner was informed that his request would be considered, no action was taken and hence, this writ petition.

The learned Additional Government Pleader has taken notice for all the respondents and submitted that if a specific time frame is granted by this Court, enquiry would be conducted and the petitioner's online patta application dated 11.10.2023 would considered and disposed of. Heard both sides and perused the materials available on record.

should have decided as to whether the petitioner is entitled for issuance of patta or not. The enquiry which was initiated is stated to have been kept pending without any reasons.

Considering the limited scope of relief sought for by the petitioner and also the submission of the learned Additional Government Pleader, this writ petition is disposed of directing the respondents to complete the enquiry based on the representation of the petitioner and give a finding by way of a speaking order as to whether the petitioner is entitled for issuance of patta as sought for by the petitioner, as quickly as possible, at a rate not later than eight weeks from the date of receipt of a copy of this order. No costs.
