Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus, to call for records pertaining to the proceedings of the second respondent's order in Na.Ka.2874/2020/Aa3 dated 12.09.2022 and quash the same as illegal, incompetent and ultra-vires and consequently direct the second respondents to reinstate the petitioner in service in a non-sensitive post. ORDER

This Writ Petition has been filed challenging the order passed by the second respondent dated 12.09.2022, thereby rejected the request made by the petitioner to reinstate her into a non sensitive post.

2. Heard the learned counsel on either side and perused the materials available on record.

3. The petitioner was working as a Village Assistant in Veeranampalayam Village, since 2007. The petitioner and the Village Administrative Officer had involved in a corruption case and the Vigilance and Anti-Corruption of Police, Namakkal had set up a trap. On the trap, the petitioner caught red handed and she was arrested and remanded to judicial custody, on 08.10.2020. Now, the petitioner submitted a representation to revoke the suspension order and to reinstate her in a non sensitive post. The said request is pending. Hence, this writ petition.

4. This Court by an order dated 29.03.2022 in W.P.No.7236 of 2022

directed the authority concerned to dispose of the representation of the petitioner on its own merits and in accordance with law. Now, after considering the representation and other records, the second respondent had passed a detailed order and thereby rejected the request made by the petitioner, since the petitioner had involved in a corruption case and now, she is facing the charge under the Prevention of Corruption Act. Already, the petitioner was working as a Village Assistant and as such, there is no non sensitive post to be granted to the petitioner on her reinstatement.

5. In view of the above, this writ petition is devoid of merits and is liable to be dismissed. Accordingly, this writ petition stands dismissed.
