O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 318(4) of BNS Act, 2023 and Section 66 (D) of the IT Act, 2000 (Corresponds to Section 420 of IPC) Crime No. 09 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2.The case of the prosecution is that the de-facto complainant had lodged a complaint before the 1 st respondent police stating that the petitioner had committed serious on-line fraud and forged the documents belongs to the de-facto complainant and involved in illegal bank transactions and cheated the de-facto complainant to the tune of Rs.3,50,000/-. Hence the respondent police registered a case against the petitioner and others.

3. The learned counsel for the petitioner submits that the petitioner has not committed any offence as alleged by the prosecution. He also submits 2/6

that the petitioner is ready to abide by any conditions that may be imposed by this Court and ready to furnish sufficient solvent sureties for his release. Hence, he prays for grant of anticipatory bail to the petitioner.

The learned Government Advocate (Criminal side) appearing for the respondent police, reiterated the prosecution case and submits that the petitioner had committed on-line fraud to the tune of Rs.3,50,000/-. He further submits that the respondent police had issued summons to the petitioner herein. He further submits that investigation has not yet completed. Therefore, he opposed for grant of anticipatory bail to the petitioner.

Taking into consideration of the fact that a copy of the notice was also produced before this Court; that the gravity of the offence committed by the petitioner; that the investigation has not yet completed; since the petitioner involved serious on-line fraud, this Court is not inclined to allow this Criminal Original Petition.

6. Accordingly, this Criminal Original Petition is dismissed. The petitioner has to approach the jurisdictional Magistrate Court, Telangana State, for obtaining Anticipatory Bail in accordance with law. 24.09.2025 MSM To 1.The XXIII Metropolitan Magistrate, Saidapet, Chennai. 2.The Inspector of Police Cyber Crime Police Station Karim Nagar Telangana State Crime No. 09 of 2025.
