ORDER

The petitioner apprehends arrest for the alleged offence under Section 3(1), 4(1) and 5(1) (a) of Immoral Traffic (Prevention) Act, in Crime No.463 of 2024, on the file of the respondent police seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner joined hands with other accused running a brothel house. Based on information received, the police searched the premises and rescued six victims.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and has not committed the offences alleged by the defacto complainant. He further submitted that the petitioner is only a landowner and was unaware of the activities of the tenants who were operating the brothel. Hence, he prays to grant anticipatory bail to the petitioner.

4. Per contra, the learned Government Advocate (Crl.Side) reported that the petitioner was aware of the tenants' activities and he was also participated with the same. He also produced the statement of the victim girl. He further submitted that there is one previous case of a similar nature pending against the petitioner. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the nature of offence committed by the petitioner, and taking note of the fact that there is one previous case, similar in nature, pending against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
