Respondents Prayer:- Writ Petition filed under Article 226 of Constitution of India for the issuance of Writ of Mandamus, forbearing the respondents from putting up any construction in the PAVADI land situated in Avalpoondurai Firka, Grama Natham, Survey No.1971/37 R.S.No.326/13 of an extent 0.04.53 hectare and consequently direct the respondents to restore the said land to its original position. The matter was listed before this Court on 22.08.2024, there was no representation on behalf the petitioner and as such, it was listed today under the caption "for dismissal" on 23.08.2024.
2. The learned counsel appearing for the petitioner submitted that the entire case bundle was handed over to the petitioner along with change of vakalat long back. Even then the petitioner failed to engage any counsel or represent himself before this Court. Today, when the matter is called, neither the petitioner nor any counsel entered appearance before this Court. It shows that the petitioner is not interested to pursue the case.
