Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the 2nd respondent to cancel the legal heir certificate for death of the Petitioner's father and mother issued by the 2nd Respondent dated 26.10.2013 in No.T.Ø.8078/2013/A3 and re-issue the fresh legal heir certificate after including the petitioner's name by disposing the petitioner's representation to the respondents 1 to 4 dated 06.11.2023 within the time stipulated by this Hon'ble Court.

Mr.Durairaj, learned Additional Government Pleader accepts notice for the official respondents, R1 to R4 and is armed with instructions to enable final disposal of this matter, even at the stage of admission. No notice is thought necessary to the private parties, i.e., R5 to R13 in light of order that is proposed to be passed taking into account their interests as well. 2 / 4

2. The prayer of the petitioner is for a mandamus simplicitor directing R2, Tahsildar, Sriperumbudur Taluk, to cancel legal heirship certificate issued by him on 26.10.2023 and re-issue the same by including his name.

3. Since the petitioner has given a representation before R1 to R4 for the same relief on 06.11.2023, it is appropriate that the authorities consider this issue.

4. Mr.Durairaj would accede to the receipt of the representation and would also agree that R2 may be directed to dispose the representation in accordance with law.

5. In light of the above, mandamus is issued to R2 to consider the representation of the petitioner dated 06.11.2023, hear the petitioner as well as the private respondents and pass orders on the representation on merits and in accordance with law, within a period of eight (8) weeks from date of receipt of a copy of this order.
