This Criminal Miscellaneous Petition has been filed seeking to condone the delay of 482 days in filing the above Criminal Appeal against the judgment dated 13.02.2024 passed in Crl.M.P.No.278 of 2024 on the file of Chief Judicial Magistrate, Puducherry.

2. Mr.B.Ravichandran, learned counsel for petitioner submitted that since the certified copy of the order was received only in the month of July 2025, the petitioner is not able to instruct counsel on record to prefer the above Criminal Appeal and only during month of August 2025, he gave papers to him, as a result of which, there is a delay of 482 days in filing the above Criminal Appeal arose, which is neither willful nor wanton. Therefore, he filed this petition to condone the delay in filing the above Criminal Appeal.

3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit seems to be justifiable one, this court is inclined to allow this petition.
