This Criminal Miscellaneous Petition has been filed seeking to condone the delay of 793 days in filing the above Criminal Appeal against the judgment dated 13.04.2023 passed in C.C.No. 80 of 2021 on the file of Special Court under EC Act/NDPS Act, Coimbatore.

2. Mr.V.Meganathan, learned Government Advocate (Crl.Side) appearing for petitioner submitted that as the petitioner took charge on 17.02.2025 and thereafter, after getting necessary approval from the authority, the petitioner is able to instruct counsel on record to prefer the above Criminal Appeal only during month of July 2025 and subsequently, he gave papers to him, as a result of which, there is a delay of 793 days in filing the above Criminal Appeal arose, which is neither willful nor wanton. Therefore, he filed this petition to condone the delay in filing the above Criminal Appeal.

3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit seems to be justifiable one, this court is inclined to allow this petition.
